These Legal Notices (the “Notices”) govern the access to and use of the website, online platform, and related services (collectively, the “Site”) operated by Manu, a Texas-based entity with its principal place of business in San Antonio, Texas, United States (“Manu,” “we,” “us,” or “our”). By accessing or using the Site, or by purchasing any products or services offered through the Site, you acknowledge that you have read, understood, and agree to be legally bound by these Notices, our Terms of Service, Privacy Policy, Shipping Policy, Return & Refund Policy, and all other applicable policies, in their entirety.

We reserve the right to modify, amend, or update these Notices at any time in our sole discretion. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of revised Notices constitutes your acceptance of such changes. It is your responsibility to review these Notices periodically.

1. Intellectual Property Rights

Any unauthorized use of the Content is strictly prohibited and may subject you to civil and criminal penalties.

All trademarks, service marks, trade names, logos, and other branding elements (collectively, the “Marks”) displayed on the Site are registered and unregistered trademarks of Manu or its licensors. Nothing contained on the Site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Mark without the prior written permission of Manu.

2. Copyright and Intellectual Property Infringement

Manu respects the intellectual property rights of third parties. If you believe that any Content on the Site infringes your copyright or other intellectual property rights, please submit a written notice to info@meetmanu.com containing the following information:

•  Identification of the copyrighted work or other intellectual property claimed to have been infringed;

•  Identification of the material that is claimed to be infringing, with sufficient detail to permit us to locate it;

•  Your contact information, including name, address, telephone number, and email address;

•  A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;

•  A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed; and

•  Your physical or electronic signature.

We will respond to properly submitted notices in accordance with applicable law, including the Digital Millennium Copyright Act (DMCA).

3. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MANU AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ACCURACY.

MANU DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, NOR DOES MANU WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED ON THE SITE.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MANU, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCTS PURCHASED THEREFROM, EVEN IF MANU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL MANU’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE NOTICES OR YOUR USE OF THE SITE EXCEED THE GREATER OF (i) THE AMOUNT PAID BY YOU TO MANU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

5. Indemnification

You agree to indemnify, defend, and hold harmless Manu, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Site; (ii) any Content you post, submit, or transmit through the Site; (iii) your violation of these Notices or any applicable law; or (iv) your violation of any rights of any third party.

6. Third-Party Content and Links

The Site may contain links to third-party websites, services, or resources. Such links are provided solely for your convenience. Manu does not control, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party sites. Your use of such third-party sites is at your own risk and subject to the terms and conditions of those sites.

7. Electronic Communications

By using the Site or providing your email address, you consent to receive electronic communications from Manu, including but not limited to order confirmations, shipping notifications, promotional emails, and legal notices. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

8. Governing Law and Dispute Resolution

These Notices shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Notices or the Site shall be instituted exclusively in the state or federal courts located in Bexar County, Texas, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

For consumers located in the European Union, nothing in these Notices shall limit any mandatory rights or remedies you may have under applicable EU consumer protection law.

9. Severability and Waiver

If any provision of these Notices is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The failure of Manu to enforce any right or provision shall not constitute a waiver of such right or provision.

10. Force Majeure

Manu shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government orders, strikes, or supply chain disruptions.
